.net verses .com

hi, theres been so much talk around the web about .com domains being better than .net domains. its now turned into a debate. so i thought why not ask google.

what i want to do is buy a domain but the .com version is taken.
so im stuck with the .net domain.

some people have said if i do buy the .net domain the site that owns the .com domain could sue me, like ha? if the .net domain is available then its mine, right?

anyway most of all, is it possible for a .net domain to get a high up ranking than .com?

They .com guys can sue u only if you are into the same business as of them,, n if its their brand, they shud have bought the .Net version as well
