Selling Windows XP on Ebay

Ok, I need your advice on this, this is my situation:

When I built my current computer I was a n00b to the world of software piracy, so I bought a full, boxed edition of Windows XP home Edition. Since then I have 'got hold of' (if you catch my drift ) a copy of Windows XP Pro. Of course, this legal version of Windows XP Home is going unused, so my question is would it be legal to see it on Ebay as it has been used but is not used any more? And would it work on that persons computer because of the activation thing?

im not sure if it will work, but im pretty sure its legal to put on ebay, cause i've put loads of stuff like that on ebay. In fact i think i helped my cousin put an xp on, but im not sure what happened after that.

you should be fine. I've stuff on before that ebay doesnt allow, and they just email you and refund your posting fee

But I'm pretty sure it dosent answer your question, but I'm sure you must be able to sell it if your newer version of windows is an upgradea as there's tons of people sellen windows xp on ebay.

btw, keep a copy of the cd and key for BACKUP purposes
